1. Definitions

www.italyfoodshop.it is an electronic store owned by S.G. Unipersonal Company, Via San Vitale 3, 48018 Faenza (Ra) Italy, created for the purpose of selling Italian food on Internet.

The user who accesses the Website to make purchases of Products (hereafter “Customer”) is obliged, prior to sending the order, to carefully read these General Conditions, which have been made available on the Website and can be consulted at any time by the Customer.

These general sales conditions (hereafter “General Conditions”) govern the purchase, made online at the website “www.italyfoodshop.it”

2. PROCEDURE TO PURCHASE PRODUCTS

The characteristics and the price of the products sold on www.italyfoodshop.it (hereinafter “Product” or “Products”) are shown in the page of each Product.
To purchase the Products, the Customer must complete and submit the order form in electronic format, following the instructions on www.italyfoodshop.it. The Customer will have to add the Product to the “Cart” and, after having read the General Conditions and the Privacy Policy and confirmed their acceptance, he will have to enter the shipping and billing information, select the desired payment method and confirm the order.

By sending the order from www.italyfoodshop.it, which has the value of a contractual offer, the Customer acknowledges and declares to have read all the information provided to him during the purchase procedure and to fully accept these General Conditions and of payment transcribed.

The contract stipulated between www.italyfoodshop.it and the Customer must be considered concluded with the acceptance of the order by www.italyfoodshop.it. This acceptance is communicated to the Customer via an order confirmation email containing a reference to these General Conditions, the order number, the shipping and billing information, the list of Products ordered with their essential characteristics and the total price, including delivery costs. The Customer will check the confirmation email and if he identifies errors in the order he will have 12 hours from the receipt of this email to contact Customer Service using the following email address: info@italyfoodshop.it. After this deadline the order will be processed for shipment and no changes will be accepted, without prejudice to the rights of the Customer referred to in article 7 below.

The contract entered into between the Seller and the Customer must be considered concluded with the sending of an order confirmation and acceptance e-mail as provided for by article 2.3 below.

Once the order has been received, www.italyfoodshop.it will check the availability of the stock to fulfill the order. In the event that one or more products are not available, the Customer Service www.italyfoodshop.it will promptly send an e-mail to the Customer who, within the following 12 hours, will have the right to reply to confirm the shipment of any additional products available or cancel it. In case of no reply within this deadline, the order will be considered confirmed and the available Products will be shipped. If only a few Products are not in stock, www.italyfoodshop.it will process the order with the available Products. In both cases, the amount relating to the missing Products will be immediately reversed depending on the chosen payment method.

3. Product information

The information and characteristics of the Products are present, with the relative Product codes, on www.italyfoodshop.it.
The visual representation of the Products on www.italyfoodshop.it, where available, normally corresponds to the photographic image accompanying the description. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be fully representative of its features and quality but may differ in color and size. In case of difference between the image and the product description, the description of the product always prevails. www.italyfoodshop.it is not responsible for any change in the packaging of the products, so it is possible that the products shipped have labels and / or packaging different from the photos on the site.

4. Prices

All the selling prices of the Products on www.italyfoodshop.it are expressed in Euros or GBP.

Unless otherwise indicated, Product prices include VAT and all other taxes.

The prices of the individual Products, from time to time indicated in www.italyfoodshop.it, cancel and replace the previous ones.

The prices applied are those indicated on www.italyfoodshop.it at the time of the Customer’s purchase order.

4.1

The weight of some products such as cured meats, cheeses or other products may vary from product to product as they are made with craft and non-industrial techniques. In these products there is the acronym c.a.. next to the weight. In the event that the product shipped is 150g less than the weight on the product sheet www.italyfoodshop.it will refound the customer for this difference. If the weight difference is between 0gr and 149gr www.italyfoodshop.it is not required to refound the customer for this weight difference.

5. METHOD OF PAYMENT AND INVOICING

www.italyfoodshop.it does not memorize the number of the customer’s credit card, but thanks to the protected communication system of the reference credit institution, from the second order, the customer who wishes – by selecting the appropriate option – may proceed with the purchase without entering your data again. The reference credit institution uses the SSL protocol to encrypt the data transmitted between its server and the Client’s browser.

PayPal

Once the order is confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his account or using a credit card or a prepaid card, or in any case according to the methods accepted by Paypal and in compliance with their relative conditions.

Invoicing orders

If the purchase is made by a professional, it will be possible to request the issue of an invoice by selecting the specific box during the order procedure and entering the invoicing details including the tax code and/or VAT reg. no. In this case the invoice will be sent via e-mail to the address provided. The professional is responsible for the correct entry of the invoicing details and he/she is expressly informed that, in case of failure to request the invoice during the order, it will not be possible to request it afterwards.

6. Shipping and delivery

The Products purchased on www.italyfoodshop.it will be delivered to the address indicated by the Customer during the purchase procedure in the “Shipment Data” field.

All purchases will be delivered by express courier (hereinafter, “Courier”) from Monday to Friday, excluding holidays and national holidays. www.italyfoodshop.it is not responsible for unforeseeable delays or not attributable to it.

7. Right of withdrawal

The customer has the right to withdraw from the purchase contract for any reason, without needing to provide explanations and without any penalty, except in the cases of exclusion provided for in the following point IV.
To exercise this right, the Customer must send www.italyfoodshop.it a communication within 14 days from the date of receipt of the Products, if he intends to exercise the withdrawal before having received the Products, the withdrawal notice may be sent at any time before of their reception.

The Customer Service of www.italyfoodshop.it will, once received the communication, open a file for the management of the return and will send the Customer of the instructions on how to return the Products.

The right of withdrawal is governed by the following conditions:

I. The right applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise the withdrawal only of a part of the purchased Product.

II. In case of exercising the right of withdrawal www.italyfoodshop.it will reimburse the customer the full amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the withdrawal notice was received, without prejudice to the right of www.italyfoodshop.it to suspend the payment of the reimbursement until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer

III. Also in order to guarantee the free return. pursuant to article 8 below, the Products must be returned in the same pachage in which they were received.

IV. In addition to the cases indicated in the Introduction (customer not a consumer and / or requiring an invoice), the right of withdrawal is excluded in the following cases:

• order of products made to measure or clearly personalized;
• order for Products that are likely to deteriorate or expire rapidly;
• order for sealed Products that do not lend themselves to being returned for hygienic reasons or connected to the protection of health or that have been opened after delivery.

With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that the Products that “risk to deteriorate or expire rapidly” include all the Food Products (including wines, spirits and beverages), since the characteristics and qualities of these types of Products are subject to alteration also as a consequence of inappropriate storage. Therefore, for hygienic and customer protection reasons, the right of withdrawal is only applicable for Products purchased on www.italyfoodshop.it which can be returned to www.italyfoodshop.it and put back on the market without endangering the health of consumers.
In the event of exclusion of the right of withdrawal, www.italyfoodshop.it will return the purchased Products to the Customer, charging the shipping costs to the Customer.

9. Warranty and Compliance Defects

In case of lack of conformity of Products sold by www.italyfoodshop.it the Customer must immediately contact Customer Service using the following email info@italyfoodshop.it
The customer has the right, at his choice and if the type of product allows it, to restore, without charge, the conformity of the product by repair or replacement, or to an adequate price reduction or termination of the contract. The Customer loses these rights if he does not report to www.italyfoodshop.it the lack of conformity within two months from the date on which he discovered the defect, provided that it is not a Product that by its nature is perishable or subject to expiry in a shorter period, in which case the defect must be reported within this shorter period.

10. ERRORS AND LIABILITY LIMITATIONS

The Product-related information supplied through the Website is constantly updated. However, it is not possible to guarantee the complete absence of errors, which the Seller cannot be considered liable for, except in case of intentional fault or serious misconduct.

The Seller reserves the right to correct the errors, inaccuracies or omissions even after an order has been sent, or to amend or update the information at any time without prior notice, without prejudice to the Customer’s rights pursuant to the General Conditions and the Consumer Code.

Except for intentional fault or serious misconduct, any right of the Customer to compensation or indemnity as well any contractual or non-contractual liability for direct or indirect damage to people and/or objects caused by the failed acceptance or processing of an order, including partial, is excluded.

By purchasing any alcoholic product you declare to be of age as per art. 7 of DL 158/2012. www.italyfoodshop.it assumes no responsibility in the case of purchases made by children under 18 years of age who have declared to have a different age.

11. Complaints

Any complaint must be forwarded to www.italyfoodshop.it using the email info@italyfoodshop.it or by registered letter to the following address:

www.italyfoodshop.it undertakes to respond to all requests received within a maximum of 5 working days.

12. Online resolution of consumer disputes (ADR e ODR)

According to Article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer can use the Joint Conciliation procedure. The Procedure can be started the consumer after having submitted a claim to the company, within 45 days, has not received a reply or has received a response not deemed satisfactory by him.

13. GOVERNING LAW AND JURISDICTION

The sales contract between the Customer and the Seller is deemed concluded in Italy and governed by Italian law. Exclusive jurisdiction to settle disputes regarding the interpretation, execution or termination of these General Conditions or of individual purchase orders if the Customer is a consumer pursuant to the Consumer Code, is granted to the forum of his/her municipality of residence or domicile, if located in the Italian territory; in all the other cases, the Court of Ravenna has exclusive territorial jurisdiction, any other possible competent forum excluded.
